Leaving an unpaid debt alone is not the same as waiting to sue later, because three things move at once: default interest that has not started running, evidence that fades every month, and a limitation period that never stops. A demand letter issued by a lawyer is therefore more than a reminder — it fixes a clear payment deadline, puts the debtor formally in default, and becomes the first piece of evidence in the file if the matter does go to court. No — and this is the most common misunderstanding we see. Sending a demand letter does not by itself interrupt the limitation period; what interrupts it is filing suit, or the debtor acknowledging the debt. That is why we check the limitation period first, and if it is close to expiring we advise preparing the claim in parallel.
You can. But Thailand's debt-collection law sets clear limits — when contact may be made, a prohibition on revealing the debt to third parties, and a ban on threats or public shaming. A pattern we see often is a creditor who collected personally and ended up on the receiving end of a complaint. A letter from a lawyer carries weight while staying inside those limits.
Often, yes. Transfer slips, chat messages acknowledging the debt, purchase orders, and delivery notes can all support a claim — though some categories of debt require written evidence before they can be sued on. We look at what you actually hold and tell you plainly whether it is enough.
If the deadline passes without payment, the options are to sue, to mediate, or to put the debtor on a written repayment plan that acknowledges the debt — and which one fits depends on the amount and on what the debtor actually owns. We assess the realistic prospect of recovery before you decide to file, because winning a judgment and collecting on it are two different things.
A demand letter is for when what you want is money — payment by a set date. A legal notice is for when you need the other side to stop, leave, terminate, or put something right: ending a contract, vacating a property, or ceasing an infringement.
